Terms of Service
Last updated: 18 August 2026
1. About us and these Terms
This website is operated by Decanted Perfumes Ltd. Throughout these Terms of Service, “we”, “us” and “our” refer to Decanted Perfumes Ltd. Our company details are set out in section 21.
We operate the Decanted Perfumes website and online store (the “Services”). Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you. Any contract for a purchase made through the Services is between you and Decanted Perfumes Ltd, not Shopify.
These Terms apply when you browse or use the Services or place an order with us. Please read them carefully before using the Services. By using the Services or placing an order, you agree to these Terms. Our Privacy Policy, Refund Policy and Shipping Policy also apply where relevant.
Nothing in these Terms limits or excludes any rights or remedies that you have under applicable consumer law.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into a binding contract to place an order or create an account. If you allow a person under 18 to use the Services through a device or account you control, you are responsible for supervising their use.
You must provide accurate, current and complete information when creating an account or placing an order. You are responsible for keeping your account credentials confidential and for activity carried out through your account. Please contact us promptly if you believe that your account has been used without permission.
3. Our products and fragrance-decant disclosure
We are an independent fragrance-decant retailer. We source genuine fragrance products and transfer the selected quantities into sample atomisers or other packaging supplied by us.
Unless a product listing expressly states otherwise, you are purchasing the selected quantity of fragrance in packaging supplied by Decanted Perfumes Ltd. You are not purchasing the full original retail bottle, branded box, original manufacturer packaging or a manufacturer-produced sample. Images of branded retail bottles are used to identify the fragrance and may not show the packaging that you will receive.
Decanted Perfumes Ltd is not affiliated with, endorsed by, sponsored by or otherwise connected with the fragrance brands whose products we decant and sell. Brand names, logos and trade marks belong to their respective owners and are used only to identify the genuine fragrance contained in the decant.
We take reasonable care to ensure that product descriptions, sizes and images are accurate. Colours and appearance may vary depending on your screen, packaging may change, and fragrance manufacturers may reformulate products. These variations do not affect your statutory rights where a product is faulty, incorrect or not as described.
Products are subject to availability. We may limit quantities, withdraw products or correct product information where reasonably necessary.
4. Orders and contract formation
When you place an order, you make an offer to purchase the products in your basket. An automated order acknowledgement confirms that we have received your order but does not necessarily mean that we have accepted it. A binding contract is formed when we send you confirmation that the order has been dispatched, unless we expressly confirm acceptance earlier.
Before dispatch, we may decline or cancel an order for a legitimate reason, including lack of stock, an obvious pricing or description error, suspected fraud, payment failure, delivery restrictions or an inability to fulfil the order. If we cancel an order after taking payment, we will refund the amount paid for the cancelled items using the original payment method.
Please check your order and delivery information carefully before submitting it. If you need to request a change or cancellation, contact us promptly. We cannot guarantee that an order can be changed or stopped once processing or dispatch has begun, but your statutory cancellation rights and our Refund Policy will continue to apply.
5. Prices, payment and promotions
Prices are shown in the currency displayed on the website or at checkout. Product prices include any taxes that we are required to include. Delivery charges and any other applicable charges will be displayed before you complete your order.
For international deliveries, customs duties, import taxes and similar charges may be imposed by the destination country. Unless checkout expressly states that these charges are included, they are the customer’s responsibility. Please check the rules that apply in the destination country before ordering.
We may change prices and promotions at any time, but changes will not affect an order that we have already accepted. Promotions may have separate terms. If we discover an obvious pricing error before dispatch, we will contact you and offer you the choice of continuing at the correct price or cancelling the affected item for a refund. If we cannot contact you, we may cancel and refund the affected item.
You confirm that you are authorised to use the payment method submitted with your order. Payments are processed by third-party payment providers and may be subject to their terms and fraud-prevention checks.
6. Shipping and delivery
Available delivery destinations, methods, charges and estimated times are shown at checkout and in our Shipping Policy. You must provide a complete and accurate delivery address.
Delivery dates are estimates unless we have expressly agreed a guaranteed date. For UK consumer orders, unless a different period has been agreed, we will deliver without undue delay and no later than 30 days after the contract is made.
Products remain at our risk until they are delivered to you or to a person you have identified to receive them. The exception is where you independently arrange a carrier that we did not offer; in that situation, risk passes when the products are delivered to that carrier.
If delivery is delayed by circumstances outside our reasonable control, we will take reasonable steps to minimise the delay and will contact you where appropriate. Your legal rights in relation to late or failed delivery are not affected.
7. Cancellations, returns and refunds
Your cancellation, return and refund rights are explained in our Refund Policy. For most products bought online, UK consumers may notify us that they wish to cancel within 14 days after receiving the goods and then have a further 14 days to return them.
Where a fragrance decant is supplied sealed, the statutory right to cancel may not apply after the seal has been broken if the product is not suitable for return for health-protection or hygiene reasons. This exception does not apply merely because you have opened delivery packaging, and it does not affect your rights if a product is faulty, damaged, incorrect or not as described.
For a change-of-mind return, you are responsible for the direct cost of returning the products unless we agree otherwise. You must take reasonable care of the products while they are in your possession. We may make a lawful deduction if handling has reduced their value beyond what would reasonably be permitted when examining them in a shop.
Where you validly cancel the whole order, we will refund the product price and the cost of our least-expensive standard delivery method. Any additional amount paid for an enhanced delivery method is not refundable unless required by law. We may withhold the refund until we receive the returned products or you provide evidence that they have been sent back, whichever occurs first. Refunds will be made within the period required by law and to the original payment method unless otherwise agreed.
8. Faulty, damaged, incorrect or misdescribed products
We are legally required to supply products that are of satisfactory quality, fit for purpose and as described. If a product arrives faulty, damaged, incorrect or materially different from its description, please contact us as soon as reasonably possible with your order details and, where appropriate, photographs.
We will provide the remedy required by applicable consumer law, which may include a refund, replacement, repair or price reduction depending on the circumstances. We will bear reasonable return costs where products are faulty, damaged, incorrect or not as described. Nothing in our Refund Policy reduces these rights.
9. Intellectual property and brand ownership
Unless otherwise stated, the website’s design and the text, graphics, photographs, videos and other content created by or licensed to us are protected by applicable United Kingdom and international intellectual-property laws. You may use the Services only for personal, non-commercial purposes. You must not reproduce, modify, distribute, republish, sell or exploit our protected content without permission, except where the law permits.
We do not claim ownership of third-party fragrance-brand names, logos, bottle designs or trade marks. Those rights remain with their respective owners. Nothing in these Terms grants you any right to use intellectual property belonging to us, Shopify or any third party.
10. Acceptable use
You must not use the Services:
- for any unlawful, fraudulent or malicious purpose;
- to infringe the rights of another person, including intellectual-property, privacy or data-protection rights;
- to transmit malware, harmful code, spam or misleading information;
- to harass, threaten, impersonate or harm another person;
- to collect personal information without a lawful basis;
- to interfere with the security, operation or availability of the Services; or
- to scrape, copy, access or exploit the Services using automated means where we have not authorised that activity.
We may take reasonable technical or legal action to prevent misuse of the Services.
11. Reviews and other content you submit
You retain ownership of reviews, photographs and other content that you submit to us. You give us a non-exclusive, worldwide, royalty-free licence to store, reproduce, display and use that content for operating, improving and promoting the Services. This licence lasts for as long as reasonably necessary for those purposes, subject to applicable law.
You confirm that you have the rights needed to submit the content and that it is accurate, lawful and does not infringe another person’s rights. We may moderate or remove content that is unlawful, misleading, abusive, irrelevant or in breach of these Terms.
12. Shopify, third-party services and external links
Shopify supplies the ecommerce platform used by our store, but it is not the seller of products purchased from us. Your purchase contract is with Decanted Perfumes Ltd.
The Services may use payment providers, delivery companies, analytics providers and other third parties. Their services may be governed by separate terms and privacy notices. We are responsible for our own obligations to you and do not exclude liability where the law makes us responsible for the acts of a third party we use to perform our contract.
Our website may contain links to external websites that we do not operate. We are not responsible for their content or practices. Following an external link is at your discretion, and you should review the third party’s terms and privacy information.
13. Privacy
We process personal information in accordance with our Privacy Policy. Because our store is hosted by Shopify, Shopify also processes certain information as described in Shopify’s privacy information.
14. Website availability and corrections
We aim to keep the Services accurate, secure and available, but we cannot guarantee uninterrupted or error-free access. We may maintain, update, restrict or withdraw parts of the Services where reasonably necessary.
We may correct typographical errors, inaccuracies or omissions relating to product descriptions, availability, pricing, promotions, delivery charges or estimated times. We will not make a material change to an accepted order without your agreement, except where permitted by law. If we cannot fulfil an accepted order as agreed, we will contact you and provide an appropriate remedy.
15. Suspension and termination
We may suspend or terminate access to an account where we reasonably believe that these Terms have been materially breached, the Services are being used unlawfully or fraudulently, or suspension is necessary to protect the Services or other users. Where appropriate, we will explain the reason and give you a reasonable opportunity to resolve the issue.
Suspension or termination does not affect rights or obligations that arose beforehand, including your rights relating to an accepted order.
16. Our responsibility to you
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory consumer rights, liability for defective products where it cannot lawfully be excluded, or any other liability that the law does not permit us to exclude or limit.
If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach or our failure to use reasonable care and skill. Loss or damage is foreseeable if it was obvious that it would happen or if both parties knew it might happen when the contract was formed.
We supply products for private and domestic use. We are not responsible for business losses, including loss of profit, revenue, business opportunity or data, resulting from use of products for commercial purposes.
17. Transfer of rights
We may transfer our rights and obligations under these Terms to another organisation, but this will not reduce your rights. We will notify you if a transfer materially affects you. You may transfer your rights or obligations only with our written agreement, except where the law allows otherwise.
18. Changes to these Terms
We may update these Terms to reflect changes to the Services, our business or applicable law. The current version will be posted on this page with its updated date. Where required by law, we will provide notice of material changes.
Changes will not retrospectively alter an order that we have already accepted unless you agree or the law permits the change.
19. Governing law and courts
These Terms and contracts made under them are governed by the laws of England and Wales. If you are a consumer, you also benefit from any mandatory protections provided by the laws of the country or part of the United Kingdom in which you live.
The courts of England and Wales have non-exclusive jurisdiction. Consumers living in Scotland or Northern Ireland may also bring proceedings in their local courts. Consumers outside the United Kingdom may have the right to bring proceedings in their country of residence where mandatory local law provides that right.
20. General provisions
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect. If we delay enforcing a right, that does not mean that we have waived it.
These Terms, together with the policies expressly referred to in them and the information provided to you during checkout, form the agreement between you and us concerning the Services and your order. Nothing in this provision excludes liability for fraud or fraudulent misrepresentation or limits your statutory rights.
Section headings are for convenience and do not affect interpretation.
